Cosa senti quando pensi alla parola “sex work”?

Quanto è vicino questo mondo al tuo?

Nel dibattito sul lavoro sessuale le persone che fanno sex work non sono quasi mai protagoniste, compaiono piuttosto sottoforma di stereotipi. La nostra voce è esclusa da questi spazi e, tra le molteplici difficoltà da affrontare, c’è anche la condizione di alienazione che ci rende invisibili l’unə con le altrə.

Ma perchè è così complicato abbattere questo muro che ci tiene lontanə?

Perché la situazione legislativa italiana attuale ( Legge Merlin, n.75 del 1958) rende facilmente perseguibili forme di mutuo aiuto. Condividere informazioni concrete per lavorare in sicurezza viene facilmente considerato dalla legge un reato perseguibile penalmente (parliamo di  reati di favoreggiamento / sfruttamento / induzione).

E qui sta la nostra preoccupazione: Non poter condividere informazioni ed esperienze ci isola e aliena rendendo le nostre vite più vulnerabili ad altre forme di violenza e pericolo.

Chi siamo e perché lo facciamo

Siamo SWIPE ( Sex Worker Intersectional Peer Education), un’associazione di sex worker e alleatə fondata in Italia nel 2020, creata per sostenere i diritti umani dellə lavoratricə che fanno sex work e per promuovere una cultura inclusiva, solidale e destigmatizzante.

Partendo dal presupposto che il Sex work è un lavoro e che ogni persona è meritevole di diritti fondamentali, con il nostro contributo vogliamo migliorare la vita e la sicurezza di chi lavora in questo settore. Desideriamo raggiungere più persone possibili bisognose di informazioni grazie a una strutturata e continuativa presenza online.

Il nostro obiettivo: l’autonomia patrimoniale per SWIPE

In questi due anni abbiamo realizzato quanto gli ostacoli sul nostro cammino siano molteplici e complessi, difficili da scavallare con le nostre sole forze. Nonostante il fine nobile dell’associazione, la minaccia costante di incorrere in sanzioni legali è stato il deterrente più grande ad esporsi pubblicamente.

Questi ostacoli hanno reso ancor più evidente quanto la discriminazione passi anche attraverso le istituzioni che limitano duramente l’esperienza dell’associazionismo sociale e del volontariato per la nostra categoria.

La paura e l’incertezza ci hanno rallentatə ma non ci hanno fermatə. Per tutelare davvero lə volontariə di oggi e di domani di SWIPE e per raggiungere le persone che più beneficerebbero dell’associazione, abbiamo bisogno di un passaggio ulteriore: dobbiamo ottenere la personalità giuridica e l’autonomia patrimoniale dell’associazione.

Raggiungere questo obiettivo significa:

• Dividere il patrimonio dell’associazione da quello dei membri. Questo è un passo fondamentale per garantire la tutela del patrimonio delle sociə nell’eventualità di cause civili.

L’autonomia patrimoniale permetterebbe, dal punto di vista civile, di mitigare i rischi concreti che affronta chi rappresenta SWIPE. Per questo, dividere il patrimonio dei singoli da quello dell’associazione è uno step necessario. Sappiamo che la responsabilità penale è individuale, e assumiamo questo rischio, tuttavia c’è un modo per renderlo più gestibile: stipulare un’assicurazione sulle spese processuali. Nell’eventualità di un processo penale, infatti, le spese verrebbero rimborsate in caso di assoluzione o non colpevolezza.

• Mitigando i rischi possiamo creare le condizioni concrete per poter condividere uno spazio sicuro di dialogo e partecipazione.

Come verranno distribuite le donazioni?

• Una guida scaricabile gratuitamente che affronta il tema della sicurezza in modo concreto. Siamo sicurə che questo documento di facile diffusione riuscirà a raggiungere chi ne ha più bisogno, diffondendo informazioni vitali per proteggere chi fa questo lavoro in Italia.

• Una comunità, una rete preziosa di scambio, soprattutto per quelle persone che non hanno a disposizione nella propria città una rete solidale attiva.

Inserendoci all’interno della rete di associazioni che da anni si occupano di sex work in Italia,i nostri obiettivi si focalizzano sulla condivisione online di informazioni verificate e sullo sviluppo della comunità incentivando l’incontro e lo scambio, ad oggi penalizzati dallo stigma e dai rischi legali.

Sappiamo che per avere un impatto su violenza, pregiudizi e stigma del lavoro sessuale dobbiamo generare alternative che nascano da un lavoro collaborativo e multidisciplinare, e questo lavoro passa anche attraverso il riconoscimento giuridico.

Sex work is work! Autonomy assets for SWIPE

What do you feel when you think of the word "sex work"?

How close is this world to yours?

In the sex work debate, people who do sex work are rarely protagonists; rather, they appear in the form of stereotypes. Our voice is excluded from these spaces and, among the many difficulties we face, there is the alienation that makes us invisible to each other.

But why is it so complicated to break down this wall that keeps us apart?

Because the current Italian legislative situation (legge Merlin, No. 75 of 1958) makes it easy to pursue virtually any form of mutual aid.

Sharing concrete information to work safely is easily considered by the law as a criminally punishable offense (we are talking about the crimes of aiding and abetting/exploitation/inducement).

And therein lies our concern: not being able to share information and experiences make us isolated and alienated by making our lives more vulnerable to other forms of violence and danger.

Who we are and why we do it

We are SWIPE ( Sex Worker Intersectional Peer Education), an association of sex workers and allies founded in Italy in 2020, created to advocate for the human rights of people doing sex work and to promote a culture that is inclusive, supportive, and destigmatizing.

Based on the premise that sex work is work and that every person is deserving of basic rights, we aim to improve the lives and safety of those who work in this industry.

We wish to reach as many people as possible in need of information through

a structured and continuous online presence.

The goal of the fundraiser: asset autonomy for SWIPE

Over the past two years, we have realized how the obstacles in our path are multiple and complex, difficult to bypass by just our efforts. Despite the noble purpose of the association, the constant threat of incurring legal penalties has been the greatest deterrent to public exposure.

These obstacles have made it even more evident how much discrimination passes through institutions that severely limit the experience of social associationism and volunteerism for our category.

Fear and uncertainty have slowed us down but have not stopped us. To truly protect today's and tomorrow's volunteers and to reach those who would most benefit from the association, we need one more step: we need to obtain the legal personality and the financial autonomy of the association.

Achieving this goal means:

• Dividing the association's assets from those of its members. This is an essential step to ensure the protection of the assets of the members in the event of civil lawsuits.

Asset autonomy would allow, from a civil perspective, to mitigate the concrete risks faced by those representing SWIPE. Therefore, dividing the assets of the individuals from that of the association is a necessary step. We know that criminal liability is individual, and we assume that risk, however, there is a way to make it more manageable: take out insurance on court costs. In the event of a criminal trial, expenses would be reimbursed in the event of an acquittal or not guilty sentence.

• By mitigating the risks, we can create the conditions to be able to share asafe space for dialogue and participation.

How will donations be distributed?

• 15.000€ - Asset Autonomy Fund 
• 2.000€ - Notarial deed 
• 2.000€ - Legal costs for advice/review of materials produced by Swipe 
• 800€ - Insurance for legal expenses for the first year of operation

• A community, a valuable network of exchange, which in Italy, for all the reasons above, is still in its budding phase.
